An agent can be helpful to a buyer while also having an agreement with the seller. That is why the role should be explained clearly.
Before relying on a recommendation or asking an agent to negotiate, ask who appointed them and whose interests they represent under the relevant agreement.
Useful follow-up questions include:
- Are you acting for the seller, the buyer or both?
- Who pays you?
- Do you have a financial interest in this property?
- Do you receive a referral payment from any recommended provider?
A connection or referral arrangement is not automatically a problem. Understanding it lets you weigh the advice with the right context.
For the legal review, choose an independent lawyer and clarify their engagement separately. You should feel able to ask questions, request a second opinion and decide whether a recommended provider is right for you.
“Someone is helping me” and “someone is appointed to represent my interests” can be different things. Ask which service you are receiving.
Quick answers
Does a Spanish estate agent represent the buyer or seller?
Ask the agent who appointed them and whose interests they represent under the agreement. Assistance with a viewing does not itself establish buyer representation.
Should an estate agent disclose referral payments?
Ask whether a recommendation involves a referral payment or other financial interest so you can assess it with that context.
How do I choose an independent property lawyer in Spain?
Choose a lawyer independently, confirm their experience and engagement terms, and ask about any connection to other parties in the transaction.
